Child Relocation

Indiana Law requires parents who intend to relocate with their children to serve a formal notice upon the non-relocating parent. Whether you decide to move to another county or to another state, if you have a Court Order with respect to custody, parenting time, grandparent visitation or child support, you may be required to comply with this statutory notice provision. If the nonrelocating parent objects to the relocation, then that parent has the right to challenge the intended relocation by filing an objection with the court in a timely manner. The relocating parent must prove that the proposed relocation is made in good faith and for a legitimate reason. A Hearing will be conducted in order to determine whether or not the current order regarding custody, parenting time, grandparent visitation or child support should be modified.
